Save for health data that may be recorded in our accident book, we do not ask for sensitive personal data and you are always free to decline to provide it.

Purchasing our Services and Merchandise

We process this personal data in order to perform our sales contract with you and to meet our legal obligations or legitimate interests as a hospitality and entertainment service provider.

We may contact you about your purchase (for example, with details on your tickets or your attendance at an event), and we may create and store a record of your purchase history.

Financial transactions via our e-store are handled directly by our third party e-commence service providers.

Via the Buy Now links on our Website, you may be re-directed to our third party e-commerce service providers that will require financial personal details in order to process your purchasing request.  Our third party e-commerce service providers include:

When you opt to make a purchase via our third party payment services providers, we will not share any personal information with them, nor will we receive any of the financial information that you provide to them.

·     education history, including training, qualifications, certifications and other academic performance indicators

·     other information that you may be asked to provide in relation to specific job requirements and criteria or that you voluntarily provide

We may legally process the personal information that you provide or that we obtain otherwise for our HR purposes, such as in relation to staffing and hiring decisions.

When we undertake such processing, we do so on the basis that we have a legitimate interest as a business, including a core business need, to be able to hire and engage employees, independent contractors and other workers to assist us in the delivery of our services and business in general.

Where an applicant is successful, we may continue to process his or her personal data throughout the period of employment or engagement, and for a period afterwards, on the basis of the performance of a contract and/or to comply with our legal obligations under applicable laws, including employment law.

Where a candidate is not successful, we may still retain their personal data for a limited period of time in compliance with legal obligations and/ or our legitimate interests.

We will not share with any third party the personal information that we obtain about you for these HR and business administration purposes, save for where:

Health and Safety

We maintain an accident book to record accidents occurring on our premises.  Where we make a record of an individual’s accident and injury or other damage sustained, we may obtain personal information, including:

·     Full name

·     Contact details (email and postal address, phone numbers)

·     Description of any injury sustained (if relevant)

·     Health or medical details, such as past injuries, name of your medical practice and GP and other relevant health-related data

Due to the nature of our business, including the ball pit experience, we maintain an accident book for the purpose of recording and following up in relation to anyone who reports an accident occurring on our premises.

We may do so in our business’ legitimate interests to operate a safe entertainment facility, where we have a legal obligation, where it is in the interests of the individual (which in rare instances could entail vital interests), where the individual has consented for us to record this information or where there is another relevant legal basis for the processing of such data.

If we share with any third party the personal information contained within the Accident Book, we will only do so where we have a legal obligation or other lawful basis for such disclosure.

For example, we may disclose information in the Accident Book for reporting and review of our safety record by insurers, government authorities or regulatory bodies (including HSE) or where compliance with other legal obligations necessitates such disclosure.

·      voice recordings of persons on or near our premises

We use CCTV within our premises and around our business site as we consider such use to be necessary for the legitimate interests of the business, including:

·       prevention of crime and deterrence of criminal activity

·       protection of buildings and assets from damage, disruption, vandalism and other crime

·       for the personal safety of staff, visitors and other members of the public

·       public safety interests

Where we process personal information in this way, we will hold that personal information on our systems for as long as is reasonably necessary to achieve these objectives.

We will not share with any third party the personal information contained within CCTV footage that we may obtain about you save for where disclosure is:

·     required in the operation of our security procedures, including sharing data with third party security service providers

·     required by law or order of an official public authority, including to support law enforcement bodies in the prevention, detection and prosecution of crime, and to assist in the defence of any civil litigation, including employment tribunal proceedings, or dispute resolution or arbitration

  • to have inaccuracies corrected or incomplete personal data made complete;
  • to ask us to restrict, stop processing, or to delete your personal data;

  1. Data Retention

In accordance with data protection laws and good commercial practice, we do not retain data in a form that permits identification of the person(s) to whom it relates for any longer than is necessary. Once the purpose for which information has been collected has been fulfilled, we will either permanently delete your personal information or remove all identifiers within it so that it is no longer personal data.  We may use such anonymised data for research and/or business analysis purposes.

  1. SENSITIVE PERSONAL DATA AND DATA RELATING TO CHILDREN

Special Category Personal Data: Special categories of personal data, such as health-related or medical information or other sensitive personal information, require higher levels of protection. For example, due to the nature of our business including offering a ball pit experience, we maintain an accident book to record and follow up in relation to anyone who reports an accident occurring on our premises.  We need to have further justification for collecting, storing and using this type of personal information, and we will only do so in accordance with applicable laws.

Children’s Data: We do not knowingly use the Website to solicit data from or market or sell to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information or may be receiving communications from us or otherwise interacting with us without consent of a parent or guardian, we ask that this be brought to our immediate attention.  We will make it our priority to address this situation and delete information relating to a child as soon as practicable.  In such an event, please contact us at hello@ballieballerson.com.

We will take commercially reasonable, appropriate technical and organisational measures to ensure a level of security appropriate to the risk that could be encountered via the use of our Website and services, taking into account the likelihood and severity those risks might pose to the rights and freedoms of our Website visitors.
